1) Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Elevate Maps services, website(s), and related applications (collectively, the “Service”), provided by Elevate Estimator (“Company,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of a company or organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, do not use the Service.

2) Eligibility & Accounts

You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for the activity that occurs on your account and for keeping your credentials secure. Notify us immediately of any unauthorized use or security breach.

You must provide accurate information and keep it up to date. We may reject or reclaim usernames or public identifiers (e.g., map slugs) that we deem inappropriate or confusing.

3) Subscriptions, Billing & Trials

  • Plans & Fees. Certain features require a paid subscription. Prices, features, and limits are described at checkout or in your account. Taxes may apply.
  • Billing. We use a third-party payment processor (e.g., Stripe). By subscribing, you authorize recurring charges to your payment method until you cancel. We do not store full card numbers.
  • Trials. If your plan includes a trial, charges begin when the trial ends unless you cancel beforehand.
  • Cancellations. You may cancel anytime to stop future charges. Cancellations take effect at the end of the current billing period. Fees already paid are generally non-refundable unless required by law or our posted refund policy.
  • Upgrades/Downgrades. Changes to your plan may take effect immediately or at the next renewal, as indicated at checkout.
  • Chargebacks. Contact us to resolve billing issues before initiating a chargeback. Unresolved chargebacks may lead to account suspension.

4) Acceptable Use

You agree not to misuse the Service. Prohibited uses include:

  • Uploading or sharing content that is unlawful, defamatory, harassing, hateful, fraudulent, deceptive, or infringes third-party rights.
  • Posting private or personal information of others without their consent, including precise location data where consent is required.
  • Attempting to gain unauthorized access to the Service or user accounts, or interfering with the Service’s operation.
  • Reverse engineering, scraping, or using automated means (other than documented APIs) to access the Service.
  • Uploading malware, spam, or content that could damage systems or data.

We may remove content, suspend, or terminate accounts that violate these Terms or applicable law.

5) User Content & Licenses

You retain ownership of content you submit to the Service, including photos, text, project data, and map pins (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, adapt, display, and distribute your User Content solely to provide, operate, improve, and promote the Service (including generating QR codes and public map links), and to comply with law.

You represent and warrant that you have all rights necessary to submit User Content and grant the above license, and that your User Content does not violate these Terms or others’ rights. You are responsible for setting items as “public” or “private” and for obtaining consent where required (e.g., for images of people or private property).

We may create de-identified or aggregated data from usage and content; we own that data and may use it for analytics and service improvement.

6) Public Maps, QR Codes & Embeds

  • Public links. If you enable public viewing, your map and related content may be accessible by anyone with the link or QR code. Treat public links like any other public web page.
  • QR codes. We may generate and host a QR image for your public map link. Anyone scanning the QR can access the linked map. Do not place QR codes on materials you do not control.
  • Embeds. If you embed your map on third-party sites, those sites’ terms and privacy practices apply in addition to ours.
  • Removal. Disabling public access or deleting items will remove public availability prospectively; cached copies or shares may persist.

7) Third-Party Services

The Service integrates with third-party services such as payment processors (e.g., Stripe), hosting and storage (e.g., Supabase, Vercel), and mapping (e.g., Google Maps). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services.

8) Privacy

Our Privacy Policy explains how we collect, use, and share personal data. By using the Service, you consent to our data practices as described there.

9) Security

We implement reasonable technical and organizational measures to protect the Service and data, but no system is 100% secure. Promptly notify us at estimates@elevateestimator.com if you suspect a security issue.

10) Intellectual Property; Feedback

The Service, including software, designs, and trademarks, is owned by Company and its licensors. Except for the limited rights expressly granted, we reserve all rights. If you submit feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without restriction.

11) Term, Suspension & Termination

We may suspend or terminate the Service or your account at any time, including for breach of these Terms or legal risk. You may terminate at any time by canceling your subscription and discontinuing use. Upon termination, your right to access the Service ceases; certain provisions survive, including Sections 5, 7, 10–15.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNTS PAID BY YOU TO COMPANY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITS; THOSE LIMITS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

14) Indemnification

You will defend, indemnify, and hold harmless Company and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

15) Governing Law; Venue

These Terms are governed by the laws of [Ontario], excluding its conflict of laws rules. The exclusive venue for any dispute relating to these Terms or the Service will be the courts located in [Barrie, Ontario], and you consent to their jurisdiction.

If you are located in the EU/UK, mandatory consumer protections and forum rights may apply in addition to the above.

16) Changes to the Service or Terms

We may modify the Service and these Terms from time to time. If we make material changes, we will provide notice (e.g., by email or in-product). Changes take effect upon posting unless otherwise stated. Your continued use after changes become effective constitutes acceptance.
